Terms of Service

1. Introduction and Acceptance of Terms

1.1 Welcome to magiya.lk (“Platform”), a website and mobile application operated by Dynamic Labs (Private) Limited (“we,” “us,” “our,” or “Company”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Dynamic Labs (Private) Limited governing your access to and use of magiya.lk, including all services, features, content, mobile applications, and related technology provided therein.

1.2 By accessing, browsing, or using magiya.lk in any manner, including but not limited to booking services, creating an account, or communicating with our AI powered booking assistants, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy, which are incorporated herein by reference.

1.3 If you do not agree to these Terms in their entirety, you are prohibited from accessing or using magiya.lk and must immediately discontinue all use of the Platform.

1.4 These Terms apply to all users of the Platform, including without limitation users who browse, book services, or interact with service providers through magiya.lk.

1.5 In the event of any conflict, inconsistency, or ambiguity between these Terms of Service, the Refund Policy, the Privacy Policy, or any other policies, guidelines, or notices published on the Platform from time to time, the documents shall be interpreted and applied in accordance with the following order of precedence:

  • The Terms of Service shall prevail over all other documents published on the Platform.
  • The Refund Policy shall prevail over the Privacy Policy and any other operational or transactional policies.
  • The Privacy Policy shall prevail in relation to matters concerning personal data and privacy.
  • All other Platform policies, guidelines, and communications shall have the lowest order of precedence and shall be interpreted in a manner consistent with the above documents.
  • In the event of any inconsistency, the higher ranking document shall govern to the extent of such inconsistency.

2. Definitions

For the purposes of these Terms:

  • “Booking”: means a reservation for transportation, travel services, or related services made through the Platform.
  • “Content”: means all text, graphics, logos, images, audio, video, software, data compilations, and other materials available on the Platform.
  • “Service Provider”: means any bus operator, travel agency, tour operator, transportation provider, or other third party entity offering services through the Platform.
  • “Services”: means all services offered through magiya.lk, including but not limited to bus ticket bookings, travel packages, tourism services, transportation arrangements, and related travel services.
  • “User Account”: means the registered account created by a User to access certain features of the Platform.

3. Description of Services

3.1 magiya.lk is a comprehensive mobility and travel booking platform that connects Users with Service Providers offering transportation and travel related services primarily within Sri Lanka.

3.2 The Services currently include, but are not limited to:

  • (a) Bus ticket bookings and reservations
  • (b) Travel package bookings
  • (c) Tourism and sightseeing services
  • (d) Transportation arrangement services
  • (e) AI powered booking assistance through messaging platforms and automated systems
  • (f) Customer support through various communication channels

3.3 Dynamic Labs (Private) Limited may expand, modify, or discontinue Services at any time without prior notice. Future services may include ride hailing services, integrated mobility solutions, and other transportation related offerings.

3.4 Services are currently available within Sri Lanka and may be subject to geographic limitations. Certain services may only be available in specific regions or cities.

4. Platform Role and Limitations

4.1 magiya.lk functions as a technology platform and intermediary that facilitates connections between Users and Service Providers. We provide the technological infrastructure to enable bookings and transactions.

4.2 Dynamic Labs (Private) Limited does not operate, own, control, manage, or endorse the transportation vehicles, travel services, or other services provided by Service Providers listed on the Platform. We act solely as an intermediary.

4.3 Dynamic Labs (Private) Limited is not a transportation company, travel agency, tour operator, or provider of travel services. We do not provide transportation or travel services directly.

4.4 Dynamic Labs (Private) Limited assumes no responsibility or liability for:

  • (a) The quality, safety, reliability, or legality of services provided by Service Providers
  • (b) The actions, omissions, representations, warranties, breaches, or negligence of any Service Provider
  • (c) Personal injury, death, property damage, or other harm resulting from interactions with Service Providers
  • (d) The condition, operation, or safety of vehicles or facilities operated by Service Providers
  • (e) Delays, cancellations, route changes, or other modifications made by Service Providers

4.5 All contractual relationships for the provision of services are formed directly between Users and Service Providers. Dynamic Labs (Private) Limited is not a party to such contracts.

5. User Accounts and Registration

5.1 Certain features of the Platform require creation of a User Account. You may register using your email address, phone number, or through third party authentication services.

5.2 Eligibility: You must be at least 18 years of age to create a User Account and make bookings through magiya.lk. If you are under 18, you may only use the Platform with the involvement and consent of a parent or legal guardian.

5.3 When creating a User Account, you agree to:

  • (a) Provide accurate, current, and complete information
  • (b) Maintain and promptly update your account information to keep it accurate and current
  • (c) Maintain the security and confidentiality of your account credentials
  • (d) Immediately notify us of any unauthorized use of your account or any other security breach
  • (e) Accept responsibility for all activities that occur under your account

5.4 You may not:

  • (a) Create an account using false or misleading information
  • (b) Create multiple accounts for the purpose of abusing the Platform or violating these Terms
  • (c) Share your account credentials with others
  • (d) Transfer or sell your account to another party

5.5 We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

6. User Responsibilities and Prohibited Conduct

6.1 Users are responsible for:

  • (a) Providing accurate, current, and complete information when making bookings
  • (b) Ensuring they arrive at designated locations on time for booked services
  • (c) Complying with all terms, conditions, and rules established by Service Providers
  • (d) Behaving respectfully toward Service Providers, their staff, and other users
  • (e) Complying with all applicable laws, regulations, and ordinances

6.2 Users are strictly prohibited from:

  • (a) Using the Platform for any unlawful purpose or in violation of these Terms
  • (b) Providing false, inaccurate, or misleading information
  • (c) Impersonating any person or entity
  • (d) Interfering with or disrupting the Platform or servers or networks connected to the Platform
  • (e) Attempting to gain unauthorized access to any portion of the Platform or any other systems or networks
  • (f) Using any automated system, including “robots,” “spiders,” or “scrapers” to access the Platform
  • (g) Transmitting viruses, malware, or other harmful code
  • (h) Collecting or harvesting any personally identifiable information from the Platform
  • (i) Using the Platform to harass, abuse, or harm another person
  • (j) Making fraudulent bookings or using fraudulent payment methods
  • (k) Attempting to reverse engineer, decompile, or disassemble any software used in the Platform
  • (l) Using the Platform to book services with no genuine intention to travel
  • (m) Exploiting promotional offers, discounts, or credits in bad faith
  • (n) Taking any action that imposes an unreasonable or disproportionately large load on the Platform infrastructure

6.3 Violation of any provision in this Section may result in immediate termination of your access to the Platform and may subject you to civil and criminal liability.

6.4 Users acknowledge that compliance with Service Provider terms and conditions is their sole responsibility. magiya.lk shall not be held liable for any consequence arising from a User’s failure to comply with Service Provider rules, policies, or requirements.

7. Bookings and Transactions

7.1 All bookings made through magiya.lk are subject to availability and acceptance by the Service Provider. We do not guarantee that any particular service will be available at any particular time.

7.2 Bookings are also subject to the specific terms and conditions of the Service Provider, which may include rules regarding luggage, passenger conduct, route information, and other service-specific requirements. Users are responsible for reviewing and complying with Service Provider terms.

7.3 By confirming a booking, you enter into a direct contractual relationship with the Service Provider. Dynamic Labs (Private) Limited is not a party to this contract.

7.4 Booking Confirmation: Once a booking is confirmed, you will receive a confirmation via email, SMS, or through the Platform. This confirmation serves as proof of your booking and should be retained until the completion of the service.

7.5 Accuracy of Information: You are responsible for ensuring that all information provided during the booking process is accurate, including passenger names, contact information, travel dates, and pickup/drop-off locations.

7.6 Booking Modifications: Requests to modify bookings (such as changing dates, times, or passenger details) are subject to the Service Provider’s modification policy and may incur additional fees. magiya.lk will assist with communicating such requests but cannot guarantee acceptance.

8. Pricing and Payment

8.1 All prices displayed on the Platform are in Sri Lankan Rupees (LKR) unless otherwise indicated.

8.2 The total price for any booking includes:

  • (a) The Service Provider’s fee for the service
  • (b) magiya.lk’s service fee (where applicable)
  • (c) Any applicable taxes, fees, or surcharges
  • (d) Any optional add-ons or upgrades selected by the User

8.3 The total price will be clearly displayed prior to confirmation of your booking. By confirming a booking, you agree to pay the total price displayed.

8.4 Service Fee: magiya.lk charges a service fee for facilitating bookings through the Platform. This fee compensates us for providing the technology platform, customer support, AI-powered booking assistance, and other services. The service fee is non-refundable except as expressly provided in our Refund Policy.

8.5 Payment Methods: We accept payment through our designated third-party payment gateway. Accepted payment methods may include credit cards, debit cards, online banking, mobile wallets, and other methods as indicated during the booking process.

8.6 By providing payment information and completing a booking, you:

  • (a) Represent and warrant that you are authorized to use the payment method provided
  • (b) Authorize us and our payment processor to charge the payment method for the total amount
  • (c) Agree to the terms and conditions of our payment processor

8.7 Payment is processed at the time of booking confirmation unless otherwise specified. You are responsible for ensuring sufficient funds or credit are available.

8.8 Price Changes: Service Providers may change prices at any time. However, once a booking is confirmed, the price will not change unless you modify your booking.

8.9 Currency Conversion: If your payment method uses a currency other than Sri Lankan Rupees, the amount charged may differ from the displayed price due to currency conversion rates and fees applied by your bank or payment provider.

8.10 Payment Disputes: If you believe you have been incorrectly charged, you must notify us within 30 days of the charge. We will investigate and work to resolve the issue, but we are not responsible for charges resulting from your use of the Platform in accordance with these Terms.

9. Cancellations and Refunds

9.1 Cancellation rights and refund eligibility are governed by our separate Refund Policy and the specific cancellation policy of the Service Provider.

9.2 To cancel a booking, you must follow the cancellation process specified on the Platform.

9.3 magiya.lk’s service fee is strictly non refundable, even if the Service Provider offers a refund for their portion of the booking. Exceptions may apply as specified in our Refund Policy.

9.4 Refunds, where applicable, will be processed using the original payment method within the timeframe specified in our Refund Policy, typically within 5–7 business days after approval.

9.5 magiya.lk reserves the right to charge a cancellation processing fee in addition to any cancellation fees charged by the Service Provider.

9.6 No shows (failure to appear for a booked service without prior cancellation) are strictly not eligible for refunds.

10. AI Powered Services and Automated Systems

10.1 magiya.lk utilizes artificial intelligence and automated systems to enhance user experience, including AI-powered booking assistants, chatbots, and automated customer service systems.

10.2 These AI systems may interact with you through various channels including the website, mobile applications, messaging platforms (such as WhatsApp, Facebook Messenger), and phone systems.

10.3 AI systems may communicate in multiple languages including Sinhala, Tamil, and English.

10.4 While we strive for accuracy, AI-powered systems may occasionally make errors or misunderstand requests. You should review all booking confirmations and details carefully before finalizing any transaction.

10.5 Important bookings or complex issues may be escalated to human customer service representatives. You may request to speak with a human representative at any time.

10.6 Conversations with AI systems may be recorded and analyzed to improve service quality and train our systems. This is governed by our Privacy Policy.

10.7 AI-powered systems are provided as a convenience and do not replace professional travel or legal advice. Dynamic Labs (Private) Limited makes no warranty that AI generated recommendations, pricing, or availability information is accurate, complete, or current at the time of interaction. You are responsible for verifying all booking details prior to confirmation.

10.8 We are committed to transparency, fairness, and accountability in the use of AI powered systems. Automated decisions that significantly affect your booking or account may be reviewed by a human representative upon request.

10.9 Users acknowledge and agree that they are solely responsible for verifying all booking details, including but not limited to pricing, availability, travel schedules, passenger information, and service conditions, before confirming any transaction on the Platform. Any reliance placed on AI-generated responses or automated communications is at the User’s own risk.

11. Intellectual Property Rights

11.1 All Content on the Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, algorithms, user interfaces, and other materials, is the exclusive property of Dynamic Labs (Private) Limited or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

11.2 The magiya.lk name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Dynamic Labs (Private) Limited or its affiliates or licensors. You may not use such marks without our prior written permission.

11.3 You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for personal, non-commercial purposes, subject to these Terms.

11.4 You may not:

  • (a) Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content except as necessary for your personal use of the Platform
  • (b) Remove or modify any copyright, trademark, or other proprietary rights notices
  • (c) Use any Content for commercial purposes without our express written consent
  • (d) Access or use the Platform in order to build a similar or competitive product or service

11.5 If you believe that any Content on the Platform infringes your intellectual property rights, please contact us at [email protected] with details of the alleged infringement.

12. User Generated Content

12.1 Users may be able to submit reviews, ratings, comments, feedback, suggestions, or other content through the Platform (“User Content”).

12.2 By submitting User Content, you grant Dynamic Labs (Private) Limited a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

12.3 You represent and warrant that:

  • (a) You own or have the necessary rights to submit the User Content
  • (b) The User Content does not violate any third party rights
  • (c) The User Content does not contain false, misleading, or defamatory information
  • (d) The User Content complies with these Terms and all applicable laws

12.4 We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate for any reason, at our sole discretion.

12.5 We do not endorse any User Content and are not responsible for the accuracy, completeness, or reliability of any User Content.

13. Third-Party Links and Services

13.1 The Platform may contain links to third-party websites, services, or resources, including websites of Service Providers, payment processors, and partner organizations.

13.2 These third-party sites are not under our control, and we are not responsible for their content, privacy policies, or practices. Links to third party sites do not constitute an endorsement.

13.3 You access third-party sites at your own risk and subject to their terms and conditions and privacy policies.

13.4 The Platform may integrate with third-party services such as payment gateways, mapping services, communication platforms, and authentication services. Use of these services is subject to their respective terms.

14. Privacy and Data Protection

14.1 Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, store, and protect your personal information.

14.2 By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

14.3 We implement reasonable security measures to protect your information, but we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

14.4 For the AI-powered services and communications, we may collect and process conversation data, booking preferences, communication patterns, and other information to improve our services and personalize your experience.

14.5 Personal data collected through the Platform is retained only for as long as necessary to provide Services, comply with legal and regulatory obligations, resolve disputes, enforce agreements, and comply with applicable laws of Sri Lanka. Upon expiry of the retention period, personal data will be securely deleted, anonymised, or otherwise handled in accordance with applicable data protection laws.

15. LIMITATION OF LIABILITY

15.1 magiya.lk acts solely as an intermediary platform. To the maximum extent permitted by applicable law, Dynamic Labs (Private) Limited’s total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the amount of the service fee paid by you to magiya.lk in respect of the specific booking giving rise to the claim.

15.2TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Dynamic Labs (Private) Limited, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • (a) Loss of profits, revenue, business opportunities, or goodwill
  • (b) Loss of data or information
  • (c) Personal injury, death, or property damage
  • (d) Service interruptions or delays
  • (e) Errors, mistakes, or inaccuracies in Content
  • (f) Any damages resulting from your use of or inability to use the Platform

15.3Dynamic Labs (Private) Limited SHALL NOT BE LIABLE FOR:

  • (a) The acts, errors, omissions, representations, warranties, breaches, or negligence of any Service Provider
  • (b) Any personal injury, death, property damage, or other damages or expenses resulting from your interactions with Service Providers
  • (c) The failure of any Service Provider to provide services as described or agreed upon
  • (d) Delays, cancellations, overbooking, strikes, or other force majeure events affecting Service Providers
  • (e) Any issues with bookings or transactions, including cancellations, changes, or disputes
  • (f) Unauthorized access to or alteration of your transmissions or data
  • (g) Statements or conduct of any third party on the Platform
  • (h) Errors or inaccuracies in AI-powered communications or automated systems
  • (i) Any reliance placed by you on information, recommendations, or content provided by AI-powered systems or automated communications on the Platform

Nothing in this Section shall exclude or limit liability to the extent that such exclusion or limitation is not permitted under applicable law, including liability for fraud, wilful misconduct, gross negligence, or any other liability that cannot be lawfully excluded.

15.4THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON INFRINGEMENT, OR COURSE OF PERFORMANCE.

15.5Dynamic Labs (Private) Limited DOES NOT WARRANT THAT:

  • (a) The Platform will function uninterrupted, secure, or error-free
  • (b) Defects will be corrected
  • (c) The Platform is free of viruses or other harmful components
  • (d) Results from using the Platform will be accurate or reliable

16. INDEMNIFICATION

16.1 You agree to indemnify, defend, and hold harmless Dynamic Labs (Private) Limited, subsidiaries, affiliates, officers, directors, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • (a) Your use or misuse of the Platform
  • (b) Your breach of these Terms
  • (c) Your violation of any applicable law or regulation
  • (d) Your violation of any third-party rights, including intellectual property rights or privacy rights
  • (e) Any User Content you submit or transmit through the Platform
  • (f) Your interactions with any Service Provider or other users
  • (g) Any bookings made through your account
  • (h) Your wilful misconduct or negligence
  • (i) Any claim by a Service Provider arising from your conduct, misuse of the Platform, or breach of a Service Provider’s terms and conditions

16.2 We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

16.3 This indemnification obligation will survive termination of these Terms and your use of the Platform.

16.4 You acknowledge that Dynamic Labs (Private) Limited enters into these Terms in reliance upon the indemnification provisions set out in this Section, which form an essential basis of the agreement between the parties.

17. FORCE MAJEURE

17.1 Dynamic Labs (Private) Limited shall not be liable for any failure or delay in performance of its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to:

  • (a) Acts of God, natural disasters, epidemics, pandemics
  • (b) War, terrorism, civil unrest, strikes, labor disputes
  • (c) Government actions, laws, regulations, or orders
  • (d) Failures of telecommunications, internet, or electronic systems
  • (e) Power outages or equipment failures

17.2 Service Providers are independent entities, and their service disruptions due to force majeure events are not the responsibility of Dynamic Labs (Private) Limited.

18. MODIFICATIONS TO SERVICES AND TERMS

18.1 Dynamic Labs (Private) Limited reserves the right to modify, suspend, or discontinue any aspect of the Platform or Services at any time, with or without notice, including but not limited to:

  • (a) Adding or removing features or functionality
  • (b) Changing pricing or fee structures
  • (c) Modifying service availability or geographic coverage
  • (d) Implementing new technologies or systems

18.2 We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the Platform, with the “Last Updated” date revised accordingly.

18.3 We will make reasonable efforts to notify you of material changes to these Terms, such as by posting a prominent notice on the Platform, sending an email to the email address associated with your account, or through in-app notifications.

18.4 Your continued use of the Platform following any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of the Platform.

18.5 It is your responsibility to review these Terms periodically for any changes.

19. TERMINATION

19.1 These Terms remain in effect while you use the Platform.

19.2 You may terminate your relationship with us at any time by discontinuing use of the Platform and, if applicable, closing your User Account.

19.3 We may terminate or suspend your access to the Platform, in whole or in part, immediately and without prior notice, for any reason, including but not limited to:

  • (a) Breach of these Terms
  • (b) Fraudulent, abusive, or illegal activity
  • (c) Extended periods of inactivity
  • (d) Requests by law enforcement or government agencies
  • (e) Unexpected technical issues or security concerns
  • (f) Engagement in conduct that we determine to be inappropriate or harmful to us, other users, or Service Providers

19.4 Upon termination:

  • (a) Your right to use the Platform immediately ceases
  • (b) We may deactivate, suspend, anonymise, or delete your User Account at our discretion. However, we may retain certain information where required for legal, regulatory, fraud prevention, dispute resolution, or legitimate business purposes in accordance with applicable laws.
  • (c) You remain liable for all outstanding obligations, including completed bookings
  • (d) Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, indemnification, and governing law

19.5 Termination does not affect any bookings already confirmed prior to termination, which remain subject to the applicable Service Provider terms and our Refund Policy.

20. DISPUTE RESOLUTION AND GOVERNING LAW

20.1 These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of laws principles.

20.2 Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, or your use of the Platform, shall be subject to the exclusive jurisdiction of the courts located in Colombo, Sri Lanka.

20.3 Before initiating any legal action, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within thirty (30) days of receiving notice. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the courts of Colombo, Sri Lanka, in accordance with Section 20.2.

20.4 You waive any right to pursue any dispute on a class, collective, or representative basis and agree that any disputes must be brought in an individual capacity.

20.5 Where disputes involve the processing of personal data, such matters shall also be subject to the applicable provisions of the Personal Data Protection Act No. 9 of 2022 of Sri Lanka.

21. MISCELLANEOUS PROVISIONS

21.1 Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, and any other legal notices published on the Platform, constitute the entire agreement between you and Dynamic Labs (Private) Limited concerning your use of the Platform and supersede all prior agreements and understandings.

21.2 Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way.

21.3 Waiver: The failure of Dynamic Labs (Private) Limited to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Dynamic Labs (Private) Limited.

21.4 Assignment: You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this provision shall be null and void.

21.5 No Agency: Nothing in these Terms shall be deemed to create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Dynamic Labs (Private) Limited.

21.6 Relationship with Service Providers: Dynamic Labs (Private) Limited’s relationship with Service Providers is that of an independent contractor. Service Providers are not employees, agents, or partners of Dynamic Labs (Private) Limited.
